  3. LICENSE AGREEMENT
  4.  
  5. THIS IS A LEGAL AGREEMENT between you and Viewpoint DataLabs International, Inc. ("Company").
  6.  If you do not agree to the terms and conditions of this License Agreement, select the button marked 
  7. "Cancel" below. If you proceed to download any of the Models and/or Datasets (the "Models") you have 
  8. selected, you thereby signify that you have agreed to all of the terms and conditions set forth below.
  9.  
  10. The Models are protected by United States copyright laws, international treaty provisions, and other laws. 
  11. You may not use, copy, display, modify or distribute the Models except in strict accordance with this 
  12. License Agreement.
  13.  
  14. Company hereby grants to you the following Limited License with respect to the Models:
  15.  
  16. You may install the Models on an unlimited number of computers provided that all such computers are all 
  17. located on your premises located at a single specific street address (or its equivalent). You may use and 
  18. access the Models only at that one location and only as follows: You may, use, copy and modify the Models 
  19. in the creation and presentation of animations and renderings which may require runtime access to the 
  20. Models; provided that you may neither: (a) separately, publish, market, distribute, transfer, sell or 
  21. sublicense all or any part of the Models; nor (b) publish, market, distribute, sell or sublicense renderings, 
  22. animations or any other product from which the Models or any part  thereof can separately be exported, 
  23. extracted, or decompiled into any redistributable form or format.  Subject to the foregoing limitations, you 
  24. are free to copy and distribute your animations and  renderings incorporating the Models.

  26. All other rights with respect to the Models and their use are reserved to Company.
  27.  
  28. LIMITATION OF LIABILITY AND WARRANTIES.  YOU ASSUME THE ENTIRE COST OF ANY 
  29. DAMAGE RESULTING FROM YOUR USE OR EXPLOITATION OF THE MODELS. YOU ASSUME 
  30. ALL RESPONSIBILITIES FOR SELECTION OF THE MODELS TO ACHIEVE YOUR INTENDED 
  31. RESULTS, AND FOR THE INSTALLATION OF, USE OF, AND RESULTS OBTAINED FROM THE 
  32. MODELS.

  34. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY DISCLAIMS ALL 
  35. WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED 
  36. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH 
  37. RESPECT TO THE MODELS AND ANY ACCOMPANYING SOFTWARE OR MATERIALS.

  39. Some States do not allow limitations on implied warranties, so the above limitation may not apply to you. 
  40.  
  41. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  TO THE MAXIMUM EXTENT PERMITTED 
  42. BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY OR ITS SUPPLIERS BE LIABLE FOR 
  43. ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS 
  44. OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, 
  45. THIRD PARTY CLAIMS, OR OTHER  LOSS) ARISING OUT OF THE USE OR INABILITY TO USE 
  46. THE MODELS OR FOR ANY OTHER REASON, EVEN IF COMPANY HAS BEEN ADVISED OF 
  47. THE POSSIBILITY OF SUCH DAMAGES.  IN NO EVENT SHALL COMPANY'S TOTAL LIABILITY 
  48. TO YOU FOR ALL DAMAGES IN ANY ONE OR MORE CAUSES OF ACTION EXCEED THE 
  49. AMOUNT, IF ANY, PAID BY YOU FOR THE  MODELS.   
  50.  
  51. Because some States do not allow the exclusion or limitation of liability for consequential or incidental 
  52. damages, the above limitation may not apply to you.
